       | Use of the Veterans Memorial Building Facilities are subject to the following conditions:
 |  
       | BOOKING GUIDELINES |  
       | 1. |  Rental fees are due when space is booked. Local check/money order
               accepted payable to “SCCVMBBT.” |  
       | 2. | Cancellation Policy: Any contracted event that is canceled by renter more than 120 days from event date may receive a refund of contracted amount, less a $300 processing fee. For cancellations made by renter for any contracted event less than 120 days from event date, Renter forfeits all fees paid, and is responsible for the payment of any outstanding contract fees due SCCVMBBT. All cancellations will be charged a minimum $300 processing fee. |  
       | 3. | A damage deposit may be required for high capacity events at
                 the sole discretion of the SCCVMBBT. |  
       | 4. | Contracts will be issued to adults over 18 years of age only. |  
       | 5. | The right to revoke permission for use of any facility at any
                 time is retained by SCCVMBBT. |  
       | 6. | The SCCVMBBT may terminate any special events activity when
               it is necessary for the safety of the public, for the protection
               of resources
                 or for violation of any rules and regulations of the City of
           Santa Cruz, deemed necessary by an act of God, or in the public interest.
                 No liability will be incurred by the SCCVMBBT, the County of
           Santa
                 Cruz, its agents or employees, by reason of such termination,
               and no rebates, refunds or fees, rents or deposits will be made
               solely
                 because of such termination. |  
       | 7. | Renter shall not assign or sublease any portion of the premises,
                 or any rights under this permit without prior approval of SCCVMBBT.
                 Any such assignment or sublease shall be void and SCCVMBBT shall
               have the right to exclude any and all persons from the facility
               attempting
                 to exercise any right or privilege under such assignment or
           sublease. |  
       | 8. |  Requests from promoters or contractors involving performance
                 by organizations or individuals with whom separate contracts
           are made will require that copies of such contracts shall be made
           available
                 to SCCVMBBT for inspection upon request. |  
       | 9. | If the event involves any type of performance, such as music,
                 theatre, poetry reading, etc., renter warrants and represents
               to SCCVMBBT that the use of the facilities will not result in
           an infringement
                 of any right protected under item 17 of the US Code (copyrights),
                 including any payments for music use to ASCAP and BMI. Renter
               further understands they will be solely responsible for the content
               of any
                 performance at the facility. Applicant further agrees to assume
               the defense and will indemnify and hold harmless the County of
           Santa Cruz,
                 SCCVMBBT, and its officers and employees from every expense,
           liability or payment including attorneys fees by reason of any claimed
           infringement
                 of any rights protected under Title 17 of the United States
           Code. |  
       | 10. |  Publicity of any type may not be released for an event until
                 renter has signed a contract with SCCVMBBT. All publicity is
           subject to approval by SCCVMBBT prior to its release. Renter agrees
           to
               adhere to City of Santa Cruz municipal code 9.49.040(B) regarding
               postering
                 in the City or Unincorporated area of the County, which is not
               allowed on telephone poles, street signs or any public property. The cost for removal of illegal posters will be charged to renter and/or deducted from renter deposit. |  
       | 11. | Events which include sales of items such as merchandise or
               concessions within facility require SCCVMBBT approval. |  
       | 12. | Any event which charges admission is subject to the City of
                 Santa Cruz admissions tax (5%). |  
       | 13. | The SCCVMBBT, when deemed in the best interest of the City
               or Community, may at its sole discretion make exceptions to the
               established
                 policies, rules and fees. |  
       |  |  
    
      | ROOM USE GUIDELINES |  
      | 1. | Renter is responsible for the set up and removal of any chairs,
          tables and equipment used in their room. Check with SCCVMBBT staff in advance of event if special assistance is needed. |  
      | 2. | Attendance will be limited to the occupant load of the facility
          as established by the County Fire Marshal or as determined by SCCVMBBT. |  
      | 3. | Entrance to the facility is allowed at the time specified on the
          approved contract and users are also expected to leave at the time
          specified. Specified times should include time necessary to prepare
          for the activity and clean-up time by the user. |  
      | 4. | Renter shall leave all facilities in a clean and orderly condition. |  
      | 5. |  Smoking is not permitted in the SCCVMBBT. |  
      | 6. | Renter shall not use tape on, or drive nails, screws, tacks, pins
          or other objects into the floors, walls, ceiling partitions, doors
          or window casings. |  
      | 7. | No structure or sets are to be built unless specifically provided
          for herein, and no shrubbery or trees are to be cut, trimmed or injured. |  
      | 8. | A deposit may be required in order to serve alcohol in the SCCVMBBT. For public admission events, alcohol must be consumed within reserved areas. State laws on alcoholic beverages prevail. |   | 9. | SCCVMBBT Security personnel will be required for any event where alcohol is served or amplified music played. |  
      | 10. | Sound amplification must be requested and explained at the time
          this contract is created. Sound levels are under the exclusive control
          of the SCCVMBBT. |  
      | 11. | Fires, pyrotechnics, fireworks or other flammable materials are
          not permitted. At no time shall exits be covered or obstructed with
          any decorations or other materials. |
